COPYRIGHT, LICENSING AND USE OF WORKS — ALSONOR

Submit a Licensing Request

1. Intellectual Property

All works presented, distributed, sold, or made available on the Alsonor website, including without limitation musical compositions, sound works, recordings, albums, singles, remixes, arrangements, album artwork, illustrations, photographs, graphic designs, visual works, videos, texts, titles, logos, artistic concepts, and other creative elements, are protected under applicable copyright and intellectual property laws.

Unless otherwise indicated, works created and published under the artist name Alsonor belong to their respective authors and rights holders.

Purchasing a musical piece or album does not constitute an assignment of copyright or a transfer of ownership in the work. It only grants the right to use the purchased file in accordance with the conditions set out in this document.

2. Listening to Previews

The Alsonor website may allow visitors to listen to audio previews through an embedded player.

These previews are provided solely to allow visitors to evaluate the works before making a purchase. Listening to a preview does not constitute a purchase, a commercial licence, or an authorization to download, reproduce, record, extract, or exploit the work.

It is prohibited to circumvent or attempt to circumvent any measures put in place to limit the listening of previews (including any duration or quality limitation), whether such measures are technical or otherwise in nature.

The mere fact that a preview is accessible, audible, or visible on the Internet does not constitute an authorization to reproduce or exploit it.

3. Purchase of Musical Pieces and Albums

The Alsonor website may offer the digital sale of individual musical pieces and complete albums.

When a customer purchases a piece or an album, they acquire a personal, limited, non-exclusive, and non-transferable licence allowing them to download and listen to the purchased file for personal use.

Unless otherwise indicated at the time of purchase, this licence notably allows the customer to:

  • download the purchased file after payment confirmation
  • keep a personal copy of the file
  • listen to the file on personal devices
  • transfer the file between their own devices
  • create a personal backup copy
  • listen to the work in a private, non-commercial setting

The purchase does not allow the customer to:

  • resell, rent, give away, or distribute the file to a third party
  • share the file by email, messaging app, social network, public cloud storage service, or file-sharing network
  • make the file available to the public
  • publish the file on a download or streaming platform
  • use the work in a video, film, advertisement, video game, podcast, or any other audiovisual production
  • modify, remix, adapt, or transform the work
  • use the work in a business, enterprise, public event, or professional activity
  • sublicense or transfer the rights granted
  • remove copyright or attribution notices
  • circumvent the technical protection measures of the site or the files

Any use exceeding the rights granted under this licence requires prior written authorization.

4. Download After Payment

Downloading a piece or album is made available after payment confirmation, subject to the conditions applicable to the payment method used.

The download link may be displayed on the order confirmation page and sent to the email address provided at the time of purchase.

The customer must provide an accurate and functional email address. Alsonor cannot be held responsible for a delivery issue caused by an incorrect address, a full inbox, a spam filter, or an issue related to the customer's email provider.

For security reasons, download links may be limited in time, in number of downloads, or tied to the customer's account and the order in question.

The customer must download and keep their files within a reasonable time. Alsonor may, where technically possible, help a customer recover a valid purchase, but does not guarantee the permanent availability of download links.

The customer is responsible for keeping a backup copy of their files after downloading.

5. File Formats and Quality

Pieces and albums are provided in the formats, audio quality, and technical specifications indicated on the product page at the time of purchase.

Available formats may vary depending on the work, the album, or site updates.

A difference between the listening quality of the preview and that of the purchased file does not necessarily constitute a defect where the product's characteristics were clearly indicated before purchase.

6. Technical Error or Defective File

If a purchased file is corrupted, incomplete, unreadable, or technically defective, the customer must contact Alsonor within a reasonable time, providing:

  • the order number
  • the email address used at the time of purchase
  • the title of the piece or album concerned
  • the nature of the problem
  • the type of device or software used, where relevant

Alsonor may, depending on the situation, provide a new download link, replace the file, or offer another reasonable solution.

This procedure does not apply to issues caused by modification of the file, incompatible use, a defective device, or improper handling by the customer.

7. Refunds and Digital Content

Due to the digital nature of the products sold, a refund may be limited or refused where downloading has begun or the file has been made accessible to the customer, subject to the mandatory rights available to the consumer under applicable law.

Where a file is defective, inaccessible, or substantially different from its description, Alsonor will assess the situation and may offer a replacement, a new download, or a refund where required or appropriate.

Nothing in this document is intended to exclude or limit any right that the customer cannot legally waive.

The refund, cancellation, and consumer protection conditions applicable to the transaction should also be reviewed before purchase.

8. Personal Use and Prohibition on Redistribution

Purchased files are intended for the customer's personal use, in accordance with the conditions already set out in Section 3.

In summary, the customer may not publish, transmit, sell, rent, lend, share, or make available a purchased piece or album to another person, even free of charge, nor upload it to a website, sharing platform, public server, social network, or any other location accessible to third parties.

The customer may, however, keep a personal backup copy, provided it remains inaccessible to third parties and is intended solely for personal use.

9. Commercial Use and Music Synchronization

The purchase of a piece or album does not include any commercial licence.

Any commercial use of an Alsonor composition or recording requires prior written authorization.

This includes, without limitation:

  • film productions
  • television series
  • documentaries
  • video games
  • advertisements
  • trailers
  • commercial web productions
  • sponsored videos
  • monetized podcasts
  • businesses or brands
  • applications and software
  • professional shows or productions
  • public events
  • digital platforms or services
  • any other production generating revenue, directly or indirectly

Where a musical work is intended to be paired with images or an audiovisual production, a synchronization licence may be required.

The use of a sound recording may also require a separate authorization concerning the master, depending on the rights held in the recording concerned.

Each request will be assessed individually based on the nature of the project, the territory, the duration of use, the media of distribution, the exclusivity requested, the scope of the campaign, and the proposed commercial terms.

10. Licence to Use

An authorization granted by Alsonor constitutes a licence limited to the conditions expressly set out in a written agreement.

Unless otherwise stated in a written agreement, any licence granted:

  • does not transfer ownership of the copyright
  • is non-exclusive
  • may not be transferred to a third party
  • may not be sublicensed
  • is limited to the project, media, territory, and period specified
  • does not permit any substantial modification of the work
  • does not permit any use other than that expressly authorized

Any use exceeding the agreed parameters will require a new written authorization.

11. Moral Rights and Integrity of the Works

The author retains their moral rights in their works to the extent provided under applicable legislation.

Any modification, alteration, adaptation, or use of a work likely to harm its integrity or the author's reputation may be refused.

Where applicable and reasonable under the circumstances, artistic credit must identify the author and/or the artist name Alsonor, in accordance with the terms agreed in the licence agreement.

12. Visual Works and Album Covers

Album covers, illustrations, photographs, graphic designs, and other visual works associated with Alsonor are also protected.

The purchase of a piece or album does not automatically include the right to download, reproduce, modify, publish, or commercially exploit the associated cover or visual work.

Their use in an advertisement, product, publication, video, website, or any other medium requires prior written permission, except where the use is strictly personal and limited to the private display of the purchased product.

13. Licensing Requests

Any person, business, advertising agency, producer, director, video game developer, content creator, or other organization wishing to use an Alsonor work for commercial purposes is invited to contact us before any use.

The request should specify, to the extent possible:

  • Title of the work
  • Nature of the project
  • Description of the intended use
  • Duration of use
  • Territories of distribution
  • Media and platforms involved
  • Approximate duration of the excerpt used
  • Type of production
  • Commercial or non-commercial use
  • Budget or nature of the production
  • Anticipated release date

A licence and its financial terms may then be established according to the characteristics of the project.

14. No Implied Authorization

The absence of a response to a request, access to the site, listening to a preview, purchasing a piece or album, its appearance in a search engine, or its presence on a digital platform does not constitute authorization for commercial use.

Any commercial authorization must be expressly granted in writing by the rights holder or their duly authorized representative.

15. Unauthorized Uses

Any reproduction, distribution, communication, adaptation, synchronization, modification, or commercial exploitation carried out without the required authorization may constitute an infringement of applicable rights.

Alsonor reserves all rights and remedies available under applicable law with respect to any unauthorized use of its works.

Alsonor may, among other things, request the removal of content, suspend or cancel access to an account, disable a download link, or take any other reasonable measure where an unauthorized use is found or suspected.

16. Orders, Accounts, and Security

The customer must provide accurate information when creating an account or placing an order.

The customer is responsible for the confidentiality of their login credentials, their email address, and any download link sent to them.

Sharing an account or allowing another person to use the access associated with an order is prohibited.

Alsonor may take reasonable measures to prevent fraud, unauthorized purchases, redistribution of files, and abuse related to downloads.

The customer represents that they have the legal age required to enter into a contract of sale under the laws applicable in their place of residence, or that they are acting with the consent of a parent or legal guardian.

18. General Provisions

These terms are governed by the laws of the province of Québec and the federal laws of Canada applicable therein. Any dispute arising from these terms falls under the exclusive jurisdiction of the courts of the judicial district where Alsonor carries on business, subject to the mandatory rights available to the consumer under applicable law.

If any provision of these terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect.

Alsonor may amend these terms at any time. The version in effect at the time of purchase applies to the transaction concerned.

All prices displayed on the site are in Canadian dollars (CAD). Applicable taxes, if any, are added at checkout in accordance with applicable law.

Purchasing a piece or album only grants access to a personal, limited, non-exclusive, and non-transferable licence permitting the download and listening of the purchased file for private use.

No resale, redistribution, publication, synchronization, adaptation, modification, commercial use, or exploitation of a work is authorized without prior written permission from the rights holder, except as provided by law.

Any licence or authorization must be interpreted in accordance with the written terms that accompany it.
